| 1. | Evidence produced by the addressee that the right of indemnity has been delegated by the sender to the addressee

| 2. | If not exercised , the recipient ' s right of indemnity shall be extinguished five years from the date the notice is served
补偿金请求权，自受领补偿人收到通知之日起，逾五年间不行使而消灭。 |
| 3. | The addressee has stated to reserve the right of indemnity at the time the partially damaged or pilfered mail item is received
二邮件一部毁损或被窃，收件人收受其馀部分时，已声明保留求偿权。 |
| 4. | Article 34 if not exercised , the sender ' s or addressee ' s right of indemnity shall be extinguished six months from the date the mail item is posted
第34条寄件人或收件人之补偿请求权，自邮件交寄之日起，逾六个月不行使而消灭。 |
| 5. | The insurer may deduct a corresponding sum from the amount of indemnity if it is not able to exercise the right of indemnity by subrogation due to the fault of the insured
由于被保险人的过错致使保险人不能行使代位请求赔偿的权利的，保险人可以相应扣减保险赔偿金。 |
| 6. | If the insured , without the insurer ' s consent , waives the right of indemnity against the third party after indemnity is made by the insurer , the waiver of the insured shall be regarded as invalid
保险人向被保险人赔偿保险金后，被保险人未经保险人同意放弃对第三者请求赔偿的权利的，该行为无效。 |
| 7. | The right of indemnity by subrogation exercised by the insurer in accordance with the first paragraph shall in no way affect the insured ' s right of indemnity against the third party for the unindemnified amount
保险人依照第一款行使代位请求赔偿的权利，不影响被保险人就未取得赔偿的部分向第三者请求赔偿的权利。 |
| 8. | Article 45 if the insured waives the right of indemnity against the third party after the occurrence of the insured event and before the insurer making the indemnity , the insurer shall bear no obligation for indemnity
第四十五条保险事故发生后，保险人未赔偿保险金之前，被保险人放弃对第三者的请求赔偿的权利的，保险人不承担赔偿保险金的责任。 |
